This Disclaimer (“Disclaimer”) applies to all users (“Users”) who access or use the official English website of Tenglong Plastic Machinery (“Company”, “We”, “Us”) and all information, products, services and content contained therein (collectively, the “Website”). By accessing or using the Website, you acknowledge that you have read, understood, and agreed to be bound by this Disclaimer, as well as all applicable laws and regulations of the country or region where you are located (including but not limited to countries in Europe, America, and Asia). If you do not agree to any terms of this Disclaimer, please immediately cease accessing or using the Website.
1. Limitation of Liability
1.1 The information provided on the Website (including but not limited to product specifications, technical parameters, performance descriptions, price information, and after-sales services) is for reference only. We make every reasonable effort to ensure the accuracy, completeness, and timeliness of the information, but we do not make any express or implied warranties, guarantees, or representations regarding the accuracy, reliability, completeness, or suitability of such information for any specific purpose. The actual parameters, performance, and prices of products shall be subject to the formal sales contract signed by both parties.
1.2 All plastic machinery products (including but not limited to injection molding machines, extruders, blow molding machines, etc.) sold by the Company are designed and manufactured in accordance with relevant international standards and general industry practices. However, we shall not be liable for any direct, indirect, incidental, consequential or special damages (including but not limited to loss of profits, business interruption, loss of data, equipment damage, personal injury, etc.) arising from the following circumstances: (a) improper operation, installation, maintenance or modification of the products by the User or a third party; (b) the User’s failure to comply with the product operation manual and safety specifications; (c) the use of the products in conjunction with non-Company accessories or equipment that do not meet the specifications; (d) force majeure (including but not limited to natural disasters, wars, government decrees, epidemics, etc.); (e) normal wear and tear of products caused by long-term use.
1.3 The Company shall not be liable for any disputes, claims, or losses arising from the User’s failure to comply with the import and export regulations, mechanical safety standards, environmental protection requirements, and other relevant laws and regulations of the country or region where the products are imported or used. It is the User’s sole responsibility to understand and comply with the local laws and regulations of the target market (including but not limited to the EU Machinery Regulation (EU) 2023/1230, South Korea’s MFDS certification requirements, and Thailand’s Import and Export Management Act) and complete all necessary certifications, approvals, and filing procedures before importing and using the products.
2. Compliance with Local Laws
2.1 The Website and the products and services provided by the Company are intended for Users who comply with the laws and regulations of their respective countries and regions. Users shall independently confirm whether the access, use of the Website and the purchase, import and use of the Company’s products comply with the local laws, regulations, rules and industry standards of the country or region where they are located, including but not limited to mechanical safety, environmental protection, import and export control, intellectual property protection and other related provisions.
2.2 For Users in European and American countries, it is your responsibility to ensure that the purchased plastic machinery products meet the local safety standards and certification requirements (such as EU CE certification and US FDA certification for food-related plastic machinery). For Users in Asian countries, you shall comply with the local import regulations, mechanical safety inspection standards, and environmental protection requirements (such as Thailand’s restrictions on imported used machinery and South Korea’s MFDS certification for mechanical products), and the Company shall not be liable for any losses caused by the User’s failure to meet the above requirements.
2.3 Special Compliance Provisions for Specific Countries
2.3.1 European Union (EU): Users must comply with the Machinery Regulation (EU) 2023/1230, which replaces Directive 2006/42/EC as of January 20, 2027, and sets out essential health and safety requirements for machinery to ensure the free movement of compliant products within the EU internal market. For plastic machinery used in food-related applications, Users must also meet the migration limit requirements specified by the European Food Safety Authority (EFSA) to ensure no harmful substances leach into foodstuffs. It is the User’s sole responsibility to complete CE certification, conduct conformity assessment procedures (including involvement of a notified body if required by Annex I of the Regulation), and ensure compliance with all relevant harmonized standards or common specifications cited in the Official Journal of the European Union.
2.3.2 United States (US): Users must ensure that plastic machinery complies with the safety standards of the Occupational Safety and Health Administration (OSHA). For machinery used in food contact applications (e.g., plastic packaging production), the equipment and its components must meet the requirements of the U.S. Food and Drug Administration (FDA) regarding food contact materials (FCMs), including the use of substances generally recognized as safe (GRAS) in all constituent parts such as resins and additives. Users shall independently complete all necessary certifications and filings required by U.S. federal and state laws, including but not limited to import declarations and safety inspections.
2.3.3 South Korea: Users must comply with the requirements of the Ministry of Food and Drug Safety (MFDS) for mechanical products. Plastic machinery shall be classified according to risk levels (Class I to Class IV), and corresponding technical documents, product tests, and quality management system certifications (such as ISO 13485 if applicable) shall be completed based on this classification. Foreign manufacturers must designate a local agent in South Korea to handle MFDS certification applications and subsequent compliance matters. The Company shall not be liable for any losses arising from failure to meet MFDS registration, testing, or local agent requirements.
2.3.4 Thailand: Users must comply with the Industrial Standards of Thailand (TISI) for imported plastic machinery, including completing TISI certification procedures, using Thai language for equipment labels and operation manuals, and meeting local requirements for noise emission and electromagnetic compatibility. Users shall also abide by Thailand’s Import and Export Management Act, especially the restrictions on imported used plastic machinery, and complete all necessary import approvals and inspections before importing the products.
2.3.5 Japan: Users must comply with Japan’s import regulations for plastic machinery, including applying for the Pre-shipment Inspection Certificate for Imported Used Mechanical and Electrical Products (for machinery with a service life ≤ 8 years) and the Import License for Mechanical and Electrical Products (for products under HS code 8462) if applicable. New machinery must meet relevant safety standards, and technical documents (including key parameters such as clamping force and injection volume) shall be translated into Japanese. Users shall also ensure compliance with Japan’s RoHS directive and environmental protection requirements for plastic machinery.
2.3.6 India: Users must comply with the Quality Control Orders (QCOs) issued by India’s Department of Chemicals and Petrochemicals (DCPC). For plastic machinery using PVC or PP materials, the materials must meet the corresponding Indian Standards (IS 17658:2021 for PVC homopolymers and IS 10951:2020 for PP molding and extrusion materials) and obtain Bureau of Indian Standards (BIS) certification, with the BIS Standard Mark affixed to the products. Users shall complete all BIS certification procedures and import filings in accordance with the BIS Act 2016 to ensure compliance with local quality and safety requirements.
3. Intellectual Property Rights
All intellectual property rights (including but not limited to trademarks, patents, copyrights, and trade secrets) of the content, products, technologies, and services contained on the Website belong to the Company or the relevant right holders authorized by the Company. Users may only use the above intellectual property rights for the purpose of understanding the Company’s products and services, and shall not copy, reproduce, distribute, modify, translate, display, sell, or use them for any other commercial purposes without the prior written permission of the Company or the relevant right holders. Any infringement of intellectual property rights shall be liable for legal liability in accordance with the law.
4. Third-Party Links and Content
The Website may contain links to third-party websites or content. These links and content are provided for the convenience of Users and do not mean that the Company endorses or assumes any responsibility for the third-party websites or their content. The Company shall not be liable for any losses, disputes, or risks arising from the User’s access to or use of third-party websites or content, including but not limited to the accuracy of information, security risks, and intellectual property infringement. Users shall independently assess the risks of third-party websites and content and bear corresponding responsibilities.
5. Modification and Termination
The Company reserves the right to modify, supplement or terminate this Disclaimer and any content on the Website at any time without prior notice. The modified Disclaimer shall take effect immediately after being published on the Website. If you continue to access or use the Website after the modification, it shall be deemed that you have agreed to the modified Disclaimer. If you do not agree to the modified Disclaimer, please cease accessing or using the Website immediately.
6. Governing Law and Dispute Resolution
This Disclaimer shall be governed by and construed in accordance with the laws of the People’s Republic of China, excluding its conflict of laws principles.
